【保險契約的構成】

第一條︰本台灣人壽真勇健醫療健康保險附約A型(0501) (以下簡稱本附約)，係依主保險契約(以下簡

稱主契約)要保人申請，並經本公司同意，以主契約之被保險人，或以主契約之被保險人及其

眷屬為本附約之被保險人，附加於主契約訂定之。

本附約保險單條款、附著之要保書、批註及其他約定書，均為本附約的構成部分。

本附約的解釋，應探求契約當事人的真意，不得拘泥於所用的文字；如有疑義時，以作有利

於被保險人的解釋為原則。

【名詞定義】

第二條︰本附約所稱名詞定義如下：

一、本附約所稱「被保險人」係指附加本附約之主契約被保險人及其「配偶」、「子女」。

二、本附約所稱「配偶」係指於本附約訂定時，主契約被保險人戶籍登記之配偶，並應將其

姓名及相關資料載明於契約中。

三、本附約所稱「子女」係指於本附約訂定時，主契約被保險人之未滿二十三歲的親生子女

、養子女，並應將其姓名及相關資料載明於契約中。

四、本附約所稱「疾病」係指被保險人自本附約生效日起持續有效滿三十日後或復效日（含

）起所發生之疾病，但續保者不受上述期間的限制，如被保險人投保時之保險年齡為零

歲者，就行政院衛生署國民健康局委託辦理「新生兒先天性代謝異常疾病篩檢」指定項

目之相關疾病，不適用前述自本附約生效日起需持續有效滿三十日之限制。

五、本附約所稱「傷害」係指被保險人於本附約有效期間內，遭受意外傷害事故，因而蒙受

之傷害。

六、本附約所稱「意外傷害事故」係指非由疾病引起之外來突發事故。

七、本附約所稱「醫院」係指依照醫療法規定領有開業執照並設有病房收治病人之公、私立

及醫療法人醫院。

八、本契約所稱「診所」係指依照醫療法規定領有開業執照之診所。

九、本附約所稱「醫師」係指領有醫師證書，合法執業者，且非要保人或被保險人本人。

十、本附約所稱「住院」係指被保險人經醫師診斷其疾病或傷害必須入住醫院，且正式辦理

住院手續並確實在醫院接受診療者。但不包含全民健康保險法第五十一條所稱之日間住

院及精神衛生法第三十五條所稱之日間留院。

十一、本附約所稱「住院醫療日額」係指本附約生效時保險單面頁上所載之投保金額，如該

金額有所變更時，則以變更後之保險金額為準。

十二、本附約所稱「同一次住院」係指被保險人於本附約有效期間，因同一疾病或傷害，或

因此引起之併發症，於出院後十四日內於同一醫院再次住院時，其各項保險金給付及

其限制，視為同一次住院辦理，倘被保險人係於本附約有效期間屆滿後出院者，本公

司就再次住院部分不予給付保險金。

十三、本附約所稱「住院日數」係指被保險人經正式辦理住院手續並確實在醫院接受診療之

日數（含入院及出院當日）。

【保險責任的開始及交付保險費】

第三條︰本附約如係與主契約同時投保，以主契約保險期間之始時為本附約之始時，並以主契約當年

度保險單週年日為本附約之到期日。如係中途申請附加者，經本公司同意後，以保險單上所

約定的日時為準，並以主契約當年度保險單週年日為本附約之到期日，其中途附加所應繳交

的保險費，應按當期應繳保險費就未到期之日數比例計算之。

本附約的保險費，在主契約繳費期間內，應與主契約保險費一併交付。

主契約於繳費期滿後，如尚屬有效契約，本附約得經本公司同意後按年繳保險費方式繼續附

加於主契約，並依本附約第十八條約定之續保保險期限辦理。

【第二期以後及續保保險費的交付、寬限期間及附約效力的停止】

第四條︰分期繳納的第二期以後保險費或續保保險費，應照本附約所載交付方法及日期，向本公司所

在地或指定地點交付，或由本公司派員前往收取，並交付本公司開發之憑證。第二期以後分

期保險費或續保保險費到期未交付時，年繳或半年繳者，自催告到達翌日起三十日內為寬限

期間；月繳或季繳者，則不另為催告，自保險單所載交付日期之翌日起三十日為寬限期間。

約定以金融機構轉帳或其他方式交付第二期以後的分期保險費或續保保險費者，本公司於知

悉未能依此項約定受領保險費時，應催告要保人交付保險費，自催告到達翌日起三十日內為

寬限期間。

逾寬限期間仍未交付者，本附約自寬限期間終了翌日起停止效力。如在寬限期間內發生本附

約約定的保險事故時，本公司仍負保險責任，但應由給付保險金內扣除欠繳保險費。

本公司依第二項約定催告要保人交付保險費時，其通知應送達於要保人，或負有交付保險費

義務之人之最後住所或居所，保險費經催告後，應於本公司營業所交付之。

【保險費的墊繳及附約效力的停止】

第五條︰本附約「保險費的墊繳及附約效力的停止」，僅適用附加於主契約保險單條款有「保險費的

墊繳及契約效力的停止」條款之約定者。主契約及本附約保險費，超過主契約寬限期間仍未

交付時，應就主契約保險費與本附約保險費之合計金額準用主契約有關「保險費的墊繳及契

約效力的停止」條款之約定辦理。

【本附約效力的恢復】

第六條︰本附約停止效力後，要保人得在停效日起二年內且於主契約有效期間內，申請復效。但主契

約保險期間屆滿後及超過本附約第十八條約定之續保保險期限者不得申請復效。

要保人於本附約停止效力之日起六個月內提出前項復效申請，並經要保人清償按日數比例計

算當期欠繳的未滿期保險費後，自翌日上午零時起，開始恢復其效力。

要保人於本附約停止效力之日起六個月後提出第一項之復效申請者，本公司得於要保人之復

效申請送達本公司之日起五日內要求要保人提供被保險人之可保證明。要保人如未於十日內

交齊本公司要求提供之可保證明者，本公司得退回該次復效之申請。

被保險人之危險程度有重大變更已達拒絕承保程度者，本公司得拒絕其復效。

本公司未於第三項約定期限內要求要保人提供可保證明，或於收齊可保證明後十五日內不為

拒絕者，視為同意復效，並經要保人清償第二項所約定之金額後，自翌日上午零時起，開始

恢復其效力。

要保人依第三項提出申請復效者，除有同項後段或第四項之情形外，於交齊可保證明，並清

償第二項所約定之金額後，自翌日上午零時起，開始恢復其效力。

本附約因第五條約定停止效力而申請復效者，復效程序依前六項約定辦理。

第一項約定期限屆滿時，本附約效力即行終止。

【保險範圍】

第七條︰被保險人於本附約有效期間內因第二條約定之疾病或傷害住院診療、接受手術治療時，本公

司依本附約約定給付保險金。

【住院醫療保險金的給付】

第八條︰被保險人因第七條之約定而住院診療時，本公司按被保險人於同一次住院期間之實際住院日

數及依下表每日給付金額給付「住院醫療保險金」：

同一次住院期間之實際住院日數每日給付金額

自第一日起至第三十日住院醫療日額×1

自第三十一日起至第三百六十五日住院醫療日額×1.5

被保險人同一保單年度同一次住院之實際住院給付日數，最高以三百六十五日為限。

【住院療養保險金的給付】

第九條︰被保險人因第七條之約定而住院診療時，本公司除依第八條約定給付「住院醫療保險金」外

，另按「住院醫療日額」的百分之五十乘以該被保險人於同一次住院期間之實際住院日數給

付「住院療養保險金」。

被保險人同一保單年度同一次住院之實際住院給付日數，最高以三百六十五日為限。

【手術醫療保險金的給付】

第十條︰被保險人因第七條之約定經醫師診斷必須且實際於登記合格之醫院或診所接受手術治療者，

本公司按「住院醫療日額」乘以附表一「手術項目表」中所列該手術項目的倍數，給付「手

術醫療保險金」。

被保險人於門診當天或同一次住院期間接受兩項以上手術時，其各項手術醫療保險金應分別

計算。但有下列二種情形時，僅按較高倍數之手術項目給付「手術醫療保險金」：

1.同一次手術中，於同一手術位置接受兩項以上之手術項目或兩項以上器官手術時。

2.同一部位接受兩次或兩次以上手術時。

被保險人所接受的手術，若不在附表一「手術項目表」所載項目且非屬第十六條除外責任範

圍內，但屬於事故當時行政院衛生署最新公布之「全民健康保險醫療費用支付標準」第二部

第二章第七節所載手術項目時，比照該支付點數計算給付倍數，每滿一千點為一倍，支付點

數換算後少於一倍者不予給付，但最高不得超過五十倍。

【手術療養保險金的給付】

第十一條︰被保險人因第七條之約定而於醫院或診所接受手術治療者，本公司除依第十條約定給付「手

術醫療保險金」外，另按「手術醫療保險金」的百分之五十，給付「手術療養保險金」。

【重大手術看護保險金的給付】

第十二條︰被保險人因第七條之約定而住院診療，並接受附表二「重大手術項目表」中所列重大手術項

目之一時，本公司除依第八條約定給付「住院醫療保險金」外，另按「住院醫療日額」的一

點五倍乘以該被保險人實際住院日數，給付「重大手術看護保險金」。

被保險人同一保單年度同一次住院之重大手術看護保險金給付日數，最高以三十日為限。

【加護病房保險金的給付】

第十三條︰被保險人因第七條之約定而進住加護病房診療時，本公司除依第八條約定給付「住院醫療保

險金」外，另按「住院醫療日額」的三倍乘以該被保險人實際進住加護病房之日數(含轉進及

轉出當日)，給付「加護病房保險金」。

被保險人同一保單年度同一次住院之實際進住加護病房給付日數，最高以三百六十五日為限

。

【燒燙傷病房保險金的給付】

第十四條︰被保險人因第七條之約定而進住燒燙傷病房診療時，本公司除依第八條約定給付「住院醫療

保險金」外，另按「住院醫療日額」的三倍乘以該被保險人實際進住燒燙傷病房之日數(含轉

進及轉出當日)，給付「燒燙傷病房保險金」。

被保險人同一保單年度同一次住院之實際進住燒燙傷病房給付日數，最高以三百六十五日為

限。

【無理賠增額保險金的給付】

第十五條︰受益人於申領第八條至第十四條之各項保險金時，如於本次保險事故發生時之前二個保單年

度(含)以上，未發生第八條至第十四條約定應給付保險事故且本附約持續有效時，本公司除

依第八條至第十四條約定給付各項保險金外，另依第八條至第十四條各項保險金給付合計金

額乘以下表所對應之增額比率，給付「無理賠增額保險金」。

連續未發生應給付保險事故之保單年度數增額比率

2 年(含)以上但未滿 3 年 20%

3 年(含)以上但未滿 4 年 30%

4 年(含)以上但未滿 5 年 40%

5 年(含)以上 50%

【除外責任】

第十六條︰被保險人因下列原因所致之疾病或傷害而住院診療或接受手術治療者，本公司不負給付各項

保險金的責任。

一、被保險人之故意行為（包括自殺及自殺未遂）。

二、被保險人之犯罪行為。

三、被保險人非法施用防制毒品相關法令所稱之毒品。

被保險人因下列事故而住院診療或接受手術治療者，本公司不負給付各項保險金的責任。

一、美容手術、外科整型。但為重建其基本功能所作之必要整型，不在此限。

二、外觀可見之天生畸形。

三、健康檢查、療養、靜養、戒毒、戒酒、護理或養老之非以直接診治病人為目的者。

四、懷孕、流產或分娩及其併發症。但下列情形不在此限：

(一)懷孕相關疾病：

1.子宮外孕。

2.葡萄胎。

3.前置胎盤。

4.胎盤早期剝離。

5.產後大出血。

6.子癲前症。

7.子癇症。

8.萎縮性胚胎。

9.胎兒染色體異常之手術。

(二)因醫療行為所必要之流產，包含：

1.因本人或其配偶患有礙優生之遺傳性、傳染性疾病或精神疾病。

2.因本人或其配偶之四親等以內之血親患有礙優生之遺傳性疾病。

3.有醫學上理由，足以認定懷孕或分娩有招致生命危險或危害身體或精神健康。

4.有醫學上理由，足以認定胎兒有畸型發育之虞。

5.因被強制性交、誘姦或與依法不得結婚者相姦而受孕者。

(三)醫療行為必要之剖腹產，並符合下列情況者：

1.產程遲滯：已進行充足引產，但第一產程之潛伏期過長（經產婦超過14小時、初

產婦超過20小時），或第一產程之活動期子宮口超過2小時仍無進一步擴張，或第

二產程超過2小時胎頭仍無下降。

2.胎兒窘迫，係指下列情形之一者：

a.在子宮無收縮情況下，胎心音圖顯示每分鐘大於160次或少於100次且呈持續性

者，或胎兒心跳低於基礎心跳每分鐘30次且持續60秒以上者。

b.胎兒頭皮酸鹼度檢查PH值少於7.20者。

3.胎頭骨盆不對稱，係指下列情形之一者：

a.胎頭過大（胎兒頭圍37公分以上）。

b.胎兒超音波檢查顯示巨嬰（胎兒體重4000公克以上）。

c.骨盆變形、狹窄（骨盆內口10公分以下或中骨盆9.5公分以下）並經骨盆腔攝影

確定者。

d.骨盆腔腫瘤（包括子宮下段之腫瘤，子宮頸之腫瘤及會引起產道壓迫阻塞之骨

盆腔腫瘤）致影響生產者。

4.胎位不正。

5.多胞胎。

6.子宮頸未全開而有臍帶脫落時。

7.兩次（含）以上的死產（懷孕24周以上，胎兒體重560公克以上）。

8.分娩相關疾病：

a.前置胎盤。

b.子癲前症及子癇症。

c.胎盤早期剝離。

d.早期破水超過24小時合併感染現象。

e.母體心肺疾病：

(a)嚴重心律不整，並附心臟科專科醫師診斷證明或心電圖檢查認定須剖腹產

者。

(b)經心臟科採用之心肺功能分級認定為第三或第四級心臟病，並附診斷證明

。

(c)嚴重肺氣腫，並附胸腔科專科醫師診斷證明。

五、不孕症、人工受孕或非以治療為目的之避孕及絕育手術。

【附約有效期間】

第十七條︰本附約的保險期間為一年，保險期間屆滿前，除第十八條、第十九條及第二十條約定外，在

主契約有效期間內，要保人得交付續保保險費，以逐年使本附約繼續有效，本公司不得拒絕

續保。

本附約續保時，按續保生效當時依規定陳報主管機關之費率及被保險人年齡重新計算保險費

，但不得針對個別被保險人身體狀況調整之。倘要保人不同意該項保險費，應於保險期間屆

滿前以書面通知本公司不續保，本附約自保險期間屆滿後即行終止。

【續保保險期限】

第十八條︰主契約被保險人年齡屆滿七十五歲之主契約當年度保單週年日時，本公司即不再受理主契約

被保險人之續保。

主契約被保險人之配偶年齡屆滿七十五歲之主契約當年度保單週年日時，本公司即不再受理

主契約被保險人配偶之續保。

主契約被保險人之子女年齡屆滿二十四歲之主契約當年度保單週年日時，本公司即不再受理

該名子女之續保。

【告知義務與本附約的解除】

第十九條︰要保人或被保險人在訂立本附約時，對於本公司要保書書面詢問的告知事項應據實說明，如

有故意隱匿，或因過失遺漏或為不實的說明，足以變更或減少本公司對於危險的估計者，本

公司得解除本附約，其保險事故發生後亦同。但危險的發生未基於其說明或未說明的事實時

，不在此限。

前項解除附約權，自本公司知有解除之原因後，經過一個月不行使而消滅；或自本附約訂立

後，經過二年不行使而消滅。

本公司通知解除本附約時，如要保人身故、居住所不明，通知不能送達時，本公司得將該項

通知送達受益人。

【附約的終止】

第二十條︰要保人得隨時終止本附約。

前項本附約之終止，自本公司收到要保人書面通知時，開始生效。

要保人依第一項約定終止本附約時，本公司應從當期已繳保險費扣除按日數比例計算已經過

期間之保險費後，將其未滿期保險費退還要保人。

本附約有下列情形之ㄧ者，其效力持續至當期已繳之保險費期滿後終止:

一、主契約終止時。

二、主契約變更為展期定期保險時。

本附約之被保險人因身故而致本附約效力終止時，不論本附約是否已領有任何一種保險金，

本公司按第三項之計算方式，將其未滿期保險費退還要保人。

【年齡的計算及錯誤的處理】

第二十一條︰被保險人的投保年齡，以足歲計算，但是未滿一歲的零數超過六個月者加算一歲，要保人

在申請投保時，應將被保險人的出生年月日在要保書填明。

被保險人的投保年齡發生錯誤時，依下列規定辦理：

一、因投保年齡的錯誤，而致溢繳保險費者，本公司無息退還溢繳部分的保險費。但在發

生保險事故後始發覺且其錯誤發生在本公司者，本公司按原繳保險費與應繳保險費的

比例提高住院醫療日額，而不退還溢繳部分的保險費。

二、因投保年齡的錯誤，而致短繳保險費者，應補足其差額。但在發生保險事故後始發覺

且其錯誤並非發生在本公司者，本公司得按原繳保險費與應繳保險費的比例減少住院

醫療日額，而不得請求補足差額。

前項第一款前段情形，其錯誤原因歸責於本公司者，應加計利息退還保險費，其利息按民

法第二百零三條法定週年利率計算。

【保險事故的通知與保險金的申請時間】

第二十二條︰要保人、被保險人或受益人應於知悉本公司應負保險責任之事故後十日內通知本公司，並

於通知後儘速檢具所需文件向本公司申請給付保險金。

本公司應於收齊前項文件後十五日內給付之。但因可歸責於本公司之事由致未在前述約定

期限內為給付者，應按年利一分加計利息給付。

【受益人】

第二十三條︰本附約各項保險金之受益人為本附約被保險人本人，本公司不受理其指定或變更。

本附約被保險人身故時，如本附約保險金尚未給付或未完全給付，則以主契約身故保險金

或喪葬費用保險金之受益人為本附約之受益人，如主契約無身故保險金或喪葬費用保險金

受益人者，則以生存保險金或滿期保險金受益人為本附約之受益人，如主契約無生存保險

金或滿期保險金受益人，則以本附約被保險人之法定繼承人為該部分保險金之受益人。

前項法定繼承人之順序及應得保險金之比例適用民法繼承編相關規定。

【保險金的申領】

第二十四條︰受益人申領本附約各項保險金時，應檢具下列文件：

一、保險金申請書。

二、保險單或其謄本。

三、醫療診斷書或住院證明。（但要保人或被保險人為醫師時，不得為被保險人出具診斷

書或住院證明。）

四、申領「加護病房保險金」或「燒燙傷病房保險金」者，須列明入、出加護病房或燒燙

傷病房之日期。

五、申領「手術醫療保險金」者，需檢具手術證明文件。

六、受益人之身分證明。

受益人申領保險金時，本公司於必要時得經受益人同意調閱被保險人之就醫相關資料，其

一切費用由本公司負擔。但不因此延展保險公司依第二十二條約定應給付之期限。

【變更住所】

第二十五條︰要保人的住所有變更時，應即以書面通知本公司。

要保人不為前項通知者，本公司之各項通知，得以本附約所載要保人之最後住所發送之。

【時效】

第二十六條︰由本附約所生的權利，自得為請求之日起，經過兩年不行使而消滅。

【批註】

第二十七條︰本附約內容的變更，或記載事項的增刪，應經要保人與本公司雙方書面同意，並由本公司

即予批註或發給批註書。

【管轄法院】

第二十八條︰因本附約涉訟者，同意以要保人住所地地方法院為第一審管轄法院，要保人的住所在中華

民國境外時，以本公司總公司所在地地方法院為第一審管轄法院。但不得排除消費者保護

法第四十七條及民事訴訟法第四百三十六條之九小額訴訟管轄法院之適用。
